Mossly Terms of Service

1. Agreement

These Terms of Service ("Terms") are a contract between you ("you", "the parent") and Mossly ("we", "us", "Mossly"). They govern your use of the Mossly mobile app and any related services we provide (collectively, the "Service").

By creating an account, you confirm you have read these Terms and the Privacy Policy, and that you agree to be bound by them. If you don't agree, don't use Mossly.

2. What Mossly is

Mossly is a bedtime-story app. You (the parent) record a short sample of your own voice; Mossly uses it to create a private voice model. You then choose a topic, and Mossly writes a personalized bedtime story (with your child as the hero) and reads it aloud in your cloned voice. Your child only listens to the finished story — they do not sign in, type, or talk to the app.

Mossly is not:

• a medical, mental-health, educational, or counselling service.
• a substitute for parental supervision or for a caregiver reading to a child.
• guaranteed to be perfect. Stories are written by an AI model and read by an AI voice; the AI can occasionally produce inaccurate, awkward, or unexpected content despite the safeguards we apply.

3. Who can use Mossly

We may refuse service or terminate your account if we discover this is misrepresented.

4. The account

• One parent per account. You may create multiple child profiles under your account (e.g. siblings); each child's data is handled per § 3 of the Privacy Policy.
• Your credentials are yours. Sign-in is through Apple or Google. Don't let others use your account; we are not liable for unauthorised use you enabled.
• You can delete the account any time via Settings → Delete account. Deletion is immediate and permanent and also deletes your voice model (see § 14 and the Privacy Policy).

5. Permitted and prohibited use

You may use Mossly for the personal, non-commercial purpose of creating bedtime stories for your own child at home. You may not:

• Record or clone any voice that is not your own. Recording another person's voice, or using Mossly to impersonate anyone, is strictly prohibited.
• Use a cloned voice to deceive, defraud, harass, or harm any person.
• Resell, redistribute, or commercialise the Service or the generated audio.
• Reverse-engineer the app or our backend beyond what applicable law (e.g. EU interoperability rules) expressly permits.
• Attempt to extract our prompts / system messages for the purpose of training another AI model.
• Use automated tools to abuse the Service or evade rate limits.
• Submit content that violates law, including content depicting child sexual abuse material (CSAM), terrorism, or violence against others. We report CSAM to the National Center for Missing & Exploited Children (NCMEC) and equivalent authorities outside the US as required.

6. AI-generated content; safety; supervision

Stories are AI-generated. Each story is written by an AI model from your chosen topic and your child's name and age, then read by an AI voice. We apply layered safeguards — a locked, age-appropriate prompt template (a fixed 4-act structure), our voice provider's built-in content filtering, and automated length / word-list validation on the output — but we cannot guarantee every story is perfect.

The parent agrees to:

• Preview or listen to stories, especially the first few, before sharing them with the child.
• Stop using a story immediately if it contains anything you find unsuitable for your child, and report it via developer@totaunion88.com so we can improve the safeguards.

You agree that Mossly does not replace your judgment as a parent.

7. Content ownership

If you give us feedback or suggestions, we are free to use that feedback without obligation or compensation.

8. Subscription and payment

Mossly offers an auto-renewing subscription, Mossly Plus, with the following plans:

• Monthly — US$4.99 / month (local-currency equivalent in Taiwan).
• Annual — US$39.99 / year.
• First month introductory price — US$0.99 for the first month, then renews at the standard monthly price.

Billing is handled entirely by Apple (App Store) or Google (Play Store); we never receive your card details. Subscriptions renew automatically unless you cancel at least 24 hours before the end of the current period. You manage or cancel your subscription in your Apple ID / Google Play account settings — not inside Mossly. Prices may change with advance notice; any change applies only to future billing periods.

9. Service availability; modifications

We will work hard to keep Mossly available, but we don't promise uninterrupted operation. We may take Mossly offline for maintenance or security fixes, modify or discontinue features, or discontinue the Service with reasonable advance notice and an opportunity to retain your generated stories.

10. Disclaimers

We disclaim, to the maximum extent permitted by law:

• Any implied warranty of merchantability, fitness for a particular purpose, or non-infringement.
• Any warranty that the Service will be uninterrupted, error-free, or that AI-generated stories will always be appropriate or accurate.
• Any warranty regarding the conduct of any third party (including MiniMax, Google, RevenueCat, or Supabase as our sub-processors).

Some jurisdictions don't allow disclaiming implied warranties; in that case, the disclaimers above apply only to the extent permitted by your local law.

11. Limitation of liability

To the maximum extent permitted by law:

• Cap: Our total liability to you for any claim arising out of or related to the Service is limited to the greater of (a) the amount you paid us in the 12 months before the claim arose or (b) US$100.
• Excluded damages: We are not liable for any indirect, incidental, special, consequential, or punitive damages — including lost data, lost profits, or emotional distress — even if we were advised of the possibility.
• Carve-out: Nothing in these Terms limits liability that cannot be limited under your local law (e.g. for gross negligence, wilful misconduct, or certain product-liability or consumer-protection rules).

12. Indemnification

You agree to defend, indemnify, and hold harmless Mossly, its officers, employees, and agents from any third-party claim arising out of:

• Your violation of these Terms.
• Your misuse of the Service, including recording or cloning a voice that is not your own.
• Your false statement that you are the child's legal guardian.
• Content you provide to the Service that infringes a third party's rights or violates the law.

We will notify you of any such claim promptly and let you control the defence (subject to our right to participate at our own cost).

13. Governing law and dispute resolution

These Terms are governed by the laws of the Republic of China (Taiwan), excluding its conflict-of-laws rules. Disputes will be resolved by the Taipei District Court, Taiwan, as the court of first instance.

EU and UK consumers: nothing in this section deprives you of your right to bring a claim in the courts of the country where you reside, as required by Article 18 of Regulation (EU) 1215/2012 or the equivalent UK rule. The European Commission's Online Dispute Resolution platform is available at https://ec.europa.eu/consumers/odr/.

14. Termination

We may suspend or terminate your account if you violate these Terms. We will give you notice and a reasonable opportunity to fix the violation, except where the violation is severe (e.g. CSAM submission, voice impersonation, payment fraud) or where notice would compromise an investigation.

You may terminate at any time via Settings → Delete account, or by emailing developer@totaunion88.com.

On termination, your account, generated stories, and voice recording are erased immediately and permanently, and we instruct our voice provider to delete your voice model. The licence granted in § 7 ends immediately. Sections 5, 7, 10, 11, 12, 13, and 15 survive termination.

15. General provisions

• Entire agreement: these Terms plus the Privacy Policy form the complete agreement between you and us, superseding any prior understanding.
• No assignment by you: you may not assign these Terms. We may assign them to a successor in a merger or acquisition.
• Severability: if any provision is held unenforceable, the rest remains in effect.
• No waiver: our failure to enforce a provision is not a waiver.
• Notices: we send notices to the email tied to your account; send notices to us at developer@totaunion88.com.
• Language: these Terms are written in English. If we provide translations, the English version controls in case of conflict.

16. Changes to these Terms

If we make material changes, we will update the "Last updated" date and notify you (by email or an in-app notice) before the changes take effect. Continued use of the Service after the effective date constitutes acceptance.
